Belius operates a digital platform for facilitating vehicle rentals between vehicle owners and renters.

2. Role of Belius

Belius exclusively provides a digital brokerage platform. Belius is not the owner of the vehicles and does not itself rent out the offered vehicles.

The rental agreement is concluded exclusively between the respective vehicle owner and the renter.

Belius assumes no liability for: • the condition of the vehicles • damages during use • contractual violations between the owner and the renter.

3. Registration and User Account

To use the platform, a user must create a user account.

The user agrees to: • provide correct and complete information • not share their account with third parties • not misuse the platform.

Belius reserves the right to suspend or delete user accounts if these terms are violated.

4. Requirements for Vehicle Rental

The user confirms that they: • hold a valid driving licence • meet the minimum age set by the owner • are legally authorised to drive a vehicle.

Verification of the driving licence can be done through the functions provided in the app.

5. Booking a Vehicle

Vehicles can be booked through the Belius platform. The owner can accept or decline booking requests.

A booking only becomes binding once it has been confirmed by the owner.

For security reasons, the exact vehicle location can only be displayed after the booking has been confirmed.

6. Prices and Payment Processing

The prices for vehicle rental are set by the respective owner.

Payment processing is handled by external payment providers, e.g.: • Stripe • Apple Pay • Google Pay • PayPal.

Belius may charge a commission for the brokerage.

7. Deposit

The owner may require a deposit for the rental.

The management and refund of the deposit is handled by the respective owner according to their own terms.

Belius assumes no responsibility for the management or refund of the deposit.

If an owner retains the deposit in the event of damage, the owner bears the applicable payment processing fees (Stripe fees). Consequently, the owner does not receive the full deposit amount, but the deposit minus the fees.

8. Cancellation Policy

The cancellation policy is based on the terms displayed on the respective vehicle page.

Unless different terms have been set, the following standard terms apply: • Up to 48 hours before rental start: free cancellation • 48 to 24 hours before rental start: 30% of the booking amount • 24 to 12 hours before rental start: 50% of the booking amount • Less than 12 hours before rental start: 100% of the booking amount

The time of cancellation relative to the planned rental start is decisive.

If an owner cancels a confirmed booking, the renter will receive a full refund of the amount already paid.

9. Use of Vehicles

The renter agrees to use the rented vehicle: • in accordance with applicable laws and regulations • with due care • not to hand it over to unauthorised persons • not to use it for illegal activities.

The renter is liable for damages that occur during the rental period, in accordance with the owner's terms and the respective insurance.

10. Vehicle Damage

Damage to the vehicle must be reported to the owner immediately.

Liability for damages is governed by: • the owner's terms • the respective insurance terms.

Belius assumes no liability for damages that occur during the use of a vehicle.

11. Reviews

After completing a booking, users can leave reviews.

Reviews must be: • truthful • objective • respectful.

Belius reserves the right to remove reviews that violate applicable law or these terms.

12. Liability

Belius is only liable for damages caused by intentional or grossly negligent conduct by Belius.

For damages in connection with vehicle rental, the respective contractual party (owner or renter) is exclusively liable.

13. Platform Availability

Belius strives to ensure the highest possible availability of the platform.

However, permanent and error-free availability cannot be guaranteed.

14. Data Protection

The processing of personal data is carried out in accordance with the Belius privacy policy, which can be viewed in the app and on the website.

15. Changes to the Terms and Conditions

Belius reserves the right to change these terms and conditions at any time.

Users will be informed about changes to the terms.

16. Applicable Law and Jurisdiction

Swiss law applies exclusively.

The place of jurisdiction is Zurich, Switzerland.
